Terms and Conditions
1. Background
1.1 Wheels of Fleet (hereinafter referred to as “the Service Provider”) intends to make available to qualifying members of the public and corporate entities the facility of accessing vehicles operated either solely by the Service Provider or by the Service Provider and a Licensee.
1.2 The Service Provider permits the User (hereinafter referred to as “the User”) to use designated vehicles on the terms and conditions set forth in this Agreement.
1.3 If the User is resident in the defined area of a Licensee, and the Licensee is a membership-based organisation, the User shall be considered a member of the Licensee organisation unless prohibited by the Licensee’s rules or until membership is declined or terminated by either the Licensee or the User.
2. User’s Agreement
2.1 The User agrees to be bound by the terms and conditions listed in this agreement. The Service Provider reserves the right to repossess the vehicle at any time without demand at the User’s expense if the terms of this Agreement are breached.
2.2 The conditions and responsibilities of the User lie primarily with the Corporate Body (if applicable) when using the vehicle with the authority and permission of a Corporate Body. It is assumed that during block-booked hours, the Corporate Body has given authority and permission for such usage.
3. Collection
Before driving away with the vehicle, the User agrees to:
- Familiarise themselves with the User’s Handbook (issued to Users).
- Comply with all safety guidelines, traffic laws, and local regulations.
- Ensure the vehicle is in proper working condition.
Definitions
- Agreement: This document.
- Collision Damage Waiver: An optional product purchased by the User to reduce the amount paid if the vehicle is damaged, lost, or stolen.
- Corporate Body: An organisation that has an agreement with the Service Provider for its authorised persons to use the vehicles.
- User: The person authorised to use the vehicle, including Corporate Body representatives.
4. Liability
4.1 Wheels of Fleet (hereinafter referred to as “the Service Provider”) shall not be liable for any injury, loss, or damage suffered by the User or any third party arising from the use of the bike hire service.
4.2 The User acknowledges that cycling involves inherent risks, including but not limited to accidents, collisions, and falls. By using the bike hire service, the User assumes all responsibility for their safety and agrees to ride the bicycles in a safe and responsible manner.
4.3 The Service Provider strongly recommends that Users wear appropriate safety gear, follow traffic rules, and exercise caution while using the bikes.
5. Responsibilities and Safety Guidelines
5.1 Bike Security
5.1.1 Bike Security: The User agrees not to leave the bikes unattended in public areas or places where they are at risk of theft or damage. Bikes should be securely locked when not in use.
5.1.2 Hirer Responsibility: The User is responsible for the security of the bike during the entire rental period. Any loss, theft, or damage to the bike will be the responsibility of the User.
5.2 Safety Measures
5.2.1 Helmet Usage: The Service Provider strongly recommends that all Users wear helmets while riding the bikes. Helmets are essential for safety and can significantly reduce the risk of head injuries.
5.2.2 Safe Riding: Users must follow traffic rules, ride responsibly, and exercise caution. The Service Provider is not liable for any accidents or injuries resulting from unsafe riding practices.
